Terms & Conditions

Thank you for booking photography, video, and/or media services with Miami Mirage Media. By booking a service with Miami Mirage Media, the Client acknowledges and agrees to the following Terms & Conditions.

PAYMENT

Payment at the time of booking may be optional or required depending on the service or booking arrangement.

When payment is not made at the time of booking, the Client may review delivered media through the designated client portal; however, downloads of final media will remain locked until the applicable invoice has been paid in full. Preview images may contain watermarks until payment is completed.

Any parking fees, valet fees, permit fees, tolls, venue access charges, or other necessary location-related expenses required to perform the contracted services may be added to the final invoice at the applicable actual cost.

Additional services or add-ons requested by the Client and accepted by Miami Mirage Media may be added to the final invoice at the applicable published or agreed-upon price.

All applicable invoices must be paid in full before final media downloads are unlocked and before the Client's license to use the delivered media becomes effective.

CANCELLATION & RESCHEDULING

Cancellations and rescheduling requests must be made at least forty-eight (48) hours before the scheduled appointment.

Clients may reschedule appointments through the available booking system within the permitted rescheduling window. Requests made less than 48 hours before the scheduled appointment must be communicated directly to Miami Mirage Media and are subject to availability and approval.

Miami Mirage Media does not impose a standard late cancellation fee. However, in cases involving late cancellations, no-shows, or repeated scheduling issues, Miami Mirage Media reserves the right to require full payment in advance for all future bookings from that Client.

When advance payment is required due to a Client's prior scheduling history, future appointments will not be considered fully confirmed until the required payment has been received.

Reasonable exceptions may be made for emergencies, severe weather, or circumstances beyond the Client's reasonable control.

ON-SITE CANCELLATION & FAILED APPOINTMENTS

If Miami Mirage Media arrives at the scheduled property or location and the session cannot reasonably proceed due to circumstances attributable to the Client, agent, homeowner, tenant, property representative, building management, HOA, or another party responsible for providing access or preparing the property, the appointment may be considered a failed appointment.

This may include, but is not limited to, denied or unavailable access, incorrect access information, excessive delays, unavailable areas, or other circumstances that prevent Miami Mirage Media from reasonably performing the contracted services.

Following a failed appointment, Miami Mirage Media reserves the right to require full payment in advance for all future bookings from that Client. Any appointment subject to such a requirement will not be considered fully confirmed until payment has been received.

Exceptions may be made for severe weather, unsafe conditions, emergencies, or circumstances reasonably determined to be outside the Client's control.

PROPERTY / LOCATION READY

All properties, venues, and locations must be fully photo and video ready before the scheduled appointment time.

The Client is responsible for ensuring that the property is cleaned, staged, organized, accessible, and otherwise prepared before Miami Mirage Media arrives.

Miami Mirage Media does not provide cleaning, decluttering, staging, furniture moving, or property preparation services and will not move or handle furniture, appliances, personal belongings, decorative items, artwork, electronics, valuables, fragile items, hazardous materials, or other property.

If Miami Mirage Media elects to proceed with a property that is not fully prepared, the property may be photographed or filmed as-is. Miami Mirage Media is not responsible for visible property conditions, clutter, cleaning quality, staging quality, hidden defects, or unwanted items appearing in the final media due to the property's condition at the time of the session.

A $50 fee may be added to the final invoice when circumstances attributable to the Client or property result in excessive waiting time, significant delays, or a return visit. Additional services or work requested beyond the original scope may be charged separately at the applicable rate.

Clients are responsible for reviewing the property preparation recommendations and resources made available by Miami Mirage Media through its website, FAQs, preparation guides, or other published materials.

All pets must be safely secured, contained, or removed from areas being photographed or filmed before the scheduled appointment. The Client is responsible for ensuring that animals do not interfere with the session or create unsafe working conditions.

PROPERTY ACCESS & AUTHORIZATION

The Client is responsible for obtaining all permissions, approvals, access credentials, and authorizations necessary for Miami Mirage Media to enter and perform services at the property.

This includes, when applicable, lockbox access, entry codes, homeowner or tenant authorization, gated community access, condominium access, building management approval, HOA approval, and access to amenities or other areas requested to be photographed or filmed.

By booking services, the Client represents that they have the authority, or have obtained the appropriate authorization, to permit Miami Mirage Media to access the property and perform the contracted services.

Miami Mirage Media is not responsible for services or images that cannot be completed due to inaccessible areas, incorrect access information, missing permissions, or restrictions imposed by homeowners, tenants, building management, HOAs, security personnel, or other third parties.

WEATHER RESCHEDULING

Outdoor services may be delayed, partially completed, or rescheduled due to severe weather, unsafe conditions, or circumstances that may materially affect safety or the reasonable performance of the contracted services.

Cloudy or overcast weather alone does not automatically qualify for rescheduling. Professional editing techniques, including appropriate sky and lighting enhancements, may be used when applicable.

When weather conditions affect only a portion of the contracted services, Miami Mirage Media may complete the unaffected services as scheduled and reschedule the affected portion when reasonably possible.

Weather-related decisions involving safety and operational feasibility will be made at the reasonable discretion of Miami Mirage Media.

A rescheduling initiated by Miami Mirage Media due to severe weather or unsafe conditions will not be considered a late cancellation or failed appointment by the Client.

DELIVERY & ARCHIVING

Standard photography services are generally delivered on the same day as the scheduled session.

Video services may require up to seven (7) days for final delivery.

Other services that are not standard photography or video services may require up to forty-eight (48) hours for delivery.

Delivery timelines may be extended when reasonably necessary due to unusually large projects, specialized editing requirements, approved revision requests, technical issues, emergencies, or circumstances beyond the reasonable control of Miami Mirage Media.

When an outstanding invoice remains unpaid, Clients may be permitted to preview available media through the designated client portal; however, downloads of final media will remain locked until the applicable invoice has been paid in full. Preview images may contain watermarks until payment is completed.

Clients are responsible for downloading and securely backing up all delivered media.

Miami Mirage Media will retain the final delivered files for up to sixty (60) days after delivery. After 60 days, Miami Mirage Media does not guarantee that files will remain available or recoverable.

Only final, processed, and edited media included in the contracted service will be delivered.

Miami Mirage Media does not provide RAW photography files, RAW video files, unedited video footage, editing project files, or other source or production files. These materials are not part of the Client's deliverables.

USAGE RIGHTS & COPYRIGHT

All photographs, videos, drone footage, floor plans, digital media, and other creative content produced by Miami Mirage Media are protected under United States Copyright Law and applicable law.

Miami Mirage Media retains full copyright ownership of all created media unless otherwise agreed in writing.

The original Client who contracts for and pays for the services is granted a non-exclusive license to use the delivered media for the marketing and promotion of the property associated with the original booking, including MLS listings, websites, social media, print materials, and related advertising.

The Client's license to use the media becomes effective only after the applicable invoice has been paid in full. Previewing media through the Client portal does not grant the Client any right to download, publish, distribute, reproduce, or otherwise use unpaid media.

The original Client may also use fully paid delivered media as part of their professional portfolio or to promote their history of represented properties, where applicable.

The license granted to the original Client is non-transferable and does not automatically transfer with the property or listing.

If a listing expires, is withdrawn, canceled, transferred, or taken over by another agent or brokerage, the new agent, brokerage, or other party does not automatically acquire rights to use the media.

Clients may not sell, transfer, sublicense, redistribute, or provide Miami Mirage Media content to third parties for their independent commercial use without prior written authorization.

Third parties, including but not limited to other real estate agents, brokerages, architects, builders, developers, interior designers, stagers, homeowners, buyers, and other businesses, may be required to obtain separate permission or licensing directly from Miami Mirage Media.

Clients may not claim authorship or copyright ownership of Miami Mirage Media content or materially alter delivered media in a manner that misrepresents the original work.

Miami Mirage Media reserves the right to use created media for portfolio display, website content, social media, advertising, competitions, publications, educational purposes, and promotional materials unless otherwise agreed in writing before the scheduled session.

Clients requesting confidentiality or non-disclosure of a property, project, event, or other content must provide written notice before the scheduled session.

FLOOR PLANS

Floor plans, measurements, dimensions, renderings, square footage calculations, and property layouts provided by Miami Mirage Media are intended solely for marketing and visual reference purposes.

While reasonable efforts are made to provide useful representations, Miami Mirage Media does not guarantee exact dimensions, total square footage, architectural accuracy, or compliance with MLS, appraisal, construction, engineering, inspection, or legal standards.

Measurements and square footage calculations may be approximate due to measurement methods, property characteristics, and other factors.

Floor plans and related measurements should not be relied upon for construction, renovation, appraisal, inspection, engineering, legal boundary determinations, contractual decisions, or other purposes requiring independently verified measurements.

Clients, buyers, agents, property owners, and third parties are responsible for independently verifying all measurements and property information when accuracy is material to a legal, financial, architectural, construction, or contractual decision.

DRONE SERVICES

All drone operations performed by Miami Mirage Media are subject to applicable Federal Aviation Administration regulations, airspace requirements, local laws, safety requirements, and operational limitations.

Drone services may be limited, delayed, rescheduled, or canceled due to restricted or controlled airspace, temporary flight restrictions, inability to obtain required authorization, weather, wind, safety concerns, legal restrictions, or other conditions that prevent the operation from being performed legally or safely.

Miami Mirage Media reserves the right to decline or cancel any drone operation when the flight cannot be legally or safely performed.

If a drone service cannot be performed due to applicable airspace restrictions or required authorization cannot be obtained, the affected drone service will be removed from the final invoice if unpaid. If the affected drone service has already been paid, the amount paid specifically for that service will be refunded.

When conditions preventing drone operations are temporary, Miami Mirage Media may elect to reschedule the drone portion of the project when reasonably possible.

The inability to perform drone services does not automatically cancel other contracted services. Other photography, video, floor plan, or related services may proceed when conditions allow.

VIDEO SERVICES

By booking video services, the Client acknowledges and accepts the general creative and editing style of Miami Mirage Media unless specific requirements are agreed upon in writing before the project.

One reasonable round of revisions is included with final video services unless otherwise specified.

Included revisions are limited to reasonable editing adjustments to the originally contracted deliverables. They do not include new filming, new shots, new angles, changes to the property, additional services, or requests outside the original scope of work.

Additional revisions, custom edits, or modification requests beyond the included revision may result in additional editing fees.

Miami Mirage Media selects music based on the creative requirements of the project and available music licensing. Requests to replace music after the video has been edited or exported may result in additional fees when the change requires additional editing.

Only final edited video deliverables are provided. RAW video files, unedited footage, project files, and other source materials are not included or delivered.

REVISIONS & RESHOOTS

One reasonable round of revisions is included for applicable delivered media unless otherwise specified.

Revision requests must be submitted within forty-eight (48) hours of delivery.

Included revisions are limited to reasonable editing adjustments to the originally contracted deliverables. Revisions do not include new photographs or video, new angles, changes to the property, additional services, or requests that were not part of the original booking.

Additional revisions, extensive modifications, or requests outside the originally contracted scope may result in additional charges.

If an issue is directly attributable to Miami Mirage Media, such as a significant technical issue or a specific shot agreed upon before the session that was unintentionally omitted, Miami Mirage Media will be given a reasonable opportunity to correct the issue or, when reasonably necessary, perform a reshoot at no additional charge.

Reshoots requested due to changes made to the property after the original session, inadequate preparation, cleaning or staging issues, items visible during the original session, newly requested photographs or angles, or other circumstances not directly attributable to Miami Mirage Media may require a new booking and additional charges.

PRICING & PROPERTY SIZE

Pricing may vary based on the selected service, property size, project requirements, and other factors disclosed during the booking process.

The Client is responsible for providing reasonably accurate property information when booking, including square footage when property size determines the applicable pricing tier.

If the actual property size differs from the category selected during booking, Miami Mirage Media reserves the right to adjust the price and final invoice to reflect the appropriate property size and services performed.

Additional services requested during the scheduled session may be added to the final invoice when Miami Mirage Media agrees to perform those services.

The pricing, selected services, add-ons, deliverables, quantities, and other options confirmed during the booking process form part of the agreement between the Client and Miami Mirage Media for that specific booking.

LIABILITY LIMITATION

Miami Mirage Media is not responsible for missed images, incomplete coverage, delays, or other limitations resulting from Client lateness, interference, access restrictions, property conditions, environmental conditions, venue restrictions, third-party interruptions, weather, traffic, emergencies, force majeure events, or technical circumstances beyond reasonable control.

In the event of equipment failure, loss, theft, file corruption, drone malfunction, data loss, or another unforeseen inability to complete or deliver a contracted service, Miami Mirage Media will be given a reasonable opportunity, when possible, to correct the issue or perform a reshoot.

If correction or reshooting is not reasonably possible, Miami Mirage Media's maximum liability shall be limited to the amount actually paid by the Client for the specific affected service.

To the extent permitted by applicable law, Miami Mirage Media shall not be liable for indirect, incidental, special, or consequential damages, including lost commissions, lost sales, loss of business opportunities, delays in selling or leasing a property, or the performance or outcome of a real estate listing.

RIGHT TO REFUSE, SUSPEND, OR TERMINATE SERVICE

Miami Mirage Media reserves the right to refuse, suspend, or terminate services when reasonably necessary due to unsafe conditions, abusive or threatening behavior, illegal requests, nonpayment, repeated violations of these Terms & Conditions, repeated late cancellations or no-shows, failed appointments, or interference that prevents Miami Mirage Media from reasonably performing the contracted services.

Miami Mirage Media may require full advance payment for all future bookings from Clients with a history of late cancellations, no-shows, failed appointments, or other significant scheduling issues. Appointments subject to such a requirement will not be considered fully confirmed until payment has been received.

If Miami Mirage Media cancels a service for reasons not attributable to the Client and the service has not been performed, amounts already paid for the unperformed service will be refunded when applicable.

GOVERNING LAW

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Florida.

To the extent permitted by applicable law, any legal proceeding arising from these Terms & Conditions or services provided by Miami Mirage Media shall be brought in the appropriate jurisdiction and venue located in Miami-Dade County, Florida.

ACCEPTANCE OF TERMS

By booking any service with Miami Mirage Media, the Client acknowledges that they have read, understood, and agreed to the Terms & Conditions in effect at the time of booking.

A booking constitutes acceptance of these Terms & Conditions regardless of whether payment is made at the time of booking or at a later date.

The Client also agrees to the pricing, selected services, add-ons, deliverables, and applicable options confirmed during the booking process for that specific order.

Any individual booking services on behalf of a company, brokerage, property owner, or other entity represents that they have the authority to make the booking and accept these Terms & Conditions on behalf of the applicable party.

Miami Mirage Media reserves the right to update these Terms & Conditions periodically. Changes will apply to future bookings made after the updated Terms & Conditions become effective and will not retroactively modify the terms applicable to previously confirmed bookings.
